Rajya Sabha Refers Bills on Removal of PM, CMs to Joint Committee Amid Opposition Uproar

New Delhi: The Rajya Sabha on Thursday decided to refer the Constitution (One Hundred and Thirtieth Amendment) Bill, 2025, the Government of Union Territories (Amendment) Bill, 2025, and the Jammu & Kashmir Reorganisation (Amendment) Bill, 2025 to a Joint Parliamentary Committee comprising 21 members from the Lok Sabha and 10 from the Rajya Sabha, to be nominated by the Speaker and the Deputy Chairman respectively. The panel has been asked to present its report by the end of the first week of the upcoming winter session.

Union Home Minister Amit Shah moved the proposal in the Upper House amid continuous sloganeering and protests from the Opposition. The motion was passed through a voice vote. Earlier, Shah had tabled the three Bills in the Lok Sabha, including the Constitution (130th Amendment) Bill, which seeks to disqualify any Union or State Minister facing corruption or serious criminal charges if they remain in custody for at least 30 days.

The Jammu and Kashmir Reorganisation (Amendment) Bill, 2025, aims to amend Section 54 of the 2019 Act, creating provisions for the removal of the Chief Minister or a Minister under similar circumstances.

Opposition parties have strongly opposed the move, calling the amendments “draconian” and “unconstitutional.” In the Lok Sabha, Opposition MPs tore and flung copies of the Bills at Home Minister Shah, objecting to provisions that could also lead to the removal of the Prime Minister or Chief Ministers facing corruption charges or prolonged detention.
