Karisma Kapoor’s children challenge authenticity of Sunjay Kapur’s will, term it ‘full of contradictions’

New Delhi: The Delhi High Court on Monday continued hearing a civil suit filed by actress Karisma Kapoor’s children, who have challenged the authenticity of a Will allegedly executed by their late father, industrialist Sunjay Kapur.

The plaintiffs are seeking a share in Kapur’s personal assets, claiming that the Will presented before the court is forged and fabricated.

Appearing for the children, senior advocate Mahesh Jethmalani argued that the document was riddled with contradictions and irregularities, asserting it could not have been authored by Sunjay Kapur himself. He pointed out that the Will erroneously used feminine pronouns such as “she” and “her” to describe the testator.

“It is absurd that the Will refers to Sunjay Kapur as a woman. It shows the audacity of those who have produced such a document,” Jethmalani said.

He further noted that the Will omitted the name of Kapur’s mother, Rani Kapur, who had always been provided for in previous arrangements, and questioned why the document was never registered, calling it a sign of “complete reluctance to formalize such an important testament.”

“If Sunjay truly intended to leave all assets to his wife, he would have registered the Will,” he contended.

Jethmalani also alleged that the Will may have been drafted on the laptop of one Nitin Sharma, as neither the defendants nor the witnesses had clarified its origin. He highlighted that the defendant is both the propounder and the sole beneficiary of the disputed Will, a factor that “raises serious doubts” about its legitimacy.

Before concluding, he stated that the burden of proof lies on the defendants to explain every suspicious aspect of the document. The court has posted the matter for the defendants’ arguments on Tuesday.

During the proceedings, Priya Sachdev Kapur’s counsel objected to Jethmalani’s portrayal of her client, saying she was unfairly depicted as “Cinderella’s stepmother.”

“Priya is more like a Fairy Godmother,” the counsel said, adding that Priya had spent nearly ₹1 crore on the children’s expenses since June 2025 and even paid for Karisma Kapoor’s flight and hotel following Sunjay Kapur’s death.

Earlier, on September 12, the Delhi High Court had allowed an application filed by Priya Sachdev Kapur and her minor son seeking correction of a previous order in the multi-crore estate dispute over Sunjay Kapur’s assets. The rectification plea, filed under Sections 151 and 152 of the Civil Procedure Code, noted that an earlier order had incorrectly recorded the appearance of Mandhira Kapur, Sunjay’s sister, even though she was not a party to the suit.

The application argued that the mistake created a misleading record and was an attempt at a “backdoor entry” into the proceedings.

The civil suit, filed by Samaira Kapur and Kiaan Raj Kapur through their mother Karisma Kapoor, seeks partition of Sunjay Kapur’s ₹30,000-crore estate, rendition of accounts, and a permanent injunction against Priya Kapur and other family members.
