Kulgam: The NIA/UAPA Court for Kulgam and Shopian on Thursday convicted Towseef Ahmed Thokar, son of Mohammad Yousaf Thokar and a resident of Khawajapora Reban, Zainapora, for his role in the 2021 Imam Sahab terror case. The case relates to FIR No. 25/2021 filed at Police Station Imam Sahab.
The court found him guilty under Sections 16, 18, and 20 of the Unlawful Activities (Prevention) Act (UAPA), Section 307 of the Indian Penal Code, and Section 7/27 of the Arms Act. Sentencing has been scheduled for November 17, 2025.
The FIR was registered following an encounter between security forces and militants on May 5, 2021, during which three militants — Danish Ahmed Mir, Zahid Bashir, and Umar Hassan Bhat — were killed. Thokar was arrested alive from the encounter site along with arms and ammunition.
In a detailed judgment, Special Judge Parvaiz Iqbal noted that rising incidents of terrorism demand a stringent judicial approach, given the threat they pose to national security, the rule of law, and societal harmony. The court, however, underscored the need to uphold constitutional protections and ensure fair trials.
The judge also commended the Investigating Officer and the prosecution for conducting a sincere and professional investigation that strengthened the case.
“The investigation has been conducted professionally, and the prosecution has systematically presented evidence that reinforced the credibility of its case,” the judgment stated.
The court concluded that the prosecution had successfully established all charges against the accused through clear and reliable evidence, proving his guilt beyond reasonable doubt.
